HOW AND WHEN AN APPEAL IS TO BE FILED
If the information sought is not given within the statuary period prescribed under the Right of Information Act in that eventuality an appeal can be filed before the Departmental Head.
One can, if information given is vague and does not satisfy the query then an appeal can be filed before the Departmental Head. If the department refuses to give the information then as per the Section 7 of the Right of Information Act, they will have to inform that the appeal can be filed. If the reply is not received within the statutory period then it is to be presumed that the application seeking the information stands rejected.
Sec 19 of the Act provides system of appeals- First Appeal.
First Appeal: Any person who is aggrieved by the decision of the Central PIO or State PIO, as the case may be, or not receiving the requested information within 30days, can prefer a first appeal before the first Appellate Authority.
